Prohibited AI practices were banned from February 2, 2025. General-purpose AI model obligations apply from August 2, 2025. High-risk AI system obligations (Annex III) are currently set to apply from August 2, 2026 — though a proposed EU amendment (the Digital Omnibus) may extend this to December 2027 for stand-alone systems. On March 13, 2026, the EU Council agreed its negotiating position on the "Digital Omnibus," a package that would delay the Annex III high-risk AI deadline from August 2026 to December 2027 (stand-alone systems) or August 2028 (AI embedded in products). However, this is not yet law — the European Parliament must still set its position, and trilogue negotiations haven't started. Prohibited AI and GPAI rules are unaffected; those are already in force. Our advice: treat August 2026 as the live deadline and use any extension as bonus runway, not a reason to delay.
Fines can reach €35 million or 7% of global annual turnover for prohibited AI, €15 million or 3% for other violations, and €7.5 million or 1% for providing incorrect information. These apply to companies of all sizes, including SMBs.
