EU AI Act — Frequently Asked Questions

Everything SMBs need to know about EU AI Act compliance.

Does the EU AI Act apply to my company?

If your company develops, deploys, or uses AI systems that affect EU residents — even if headquartered outside the EU — the regulation applies to you. This covers AI used in HR, finance, healthcare, customer service, and operations.

What is the deadline for EU AI Act compliance?

Prohibited AI practices were banned from February 2, 2025. General-purpose AI model obligations apply from August 2, 2025. High-risk AI system obligations (Annex III) are currently set to apply from August 2, 2026 — though a proposed EU amendment (the Digital Omnibus) may extend this to December 2027 for stand-alone systems. That amendment is not yet law. Start now to stay ahead regardless of the final timeline.

Is the EU AI Act deadline being pushed back?

Possibly — for Annex III high-risk AI obligations. On March 13, 2026, the EU Council agreed its negotiating position on the "Digital Omnibus," a package that would delay the Annex III high-risk AI deadline from August 2026 to December 2027 (stand-alone systems) or August 2028 (AI embedded in products). However, this is not yet law — the European Parliament must still set its position, and trilogue negotiations haven't started. Prohibited AI and GPAI rules are unaffected; those are already in force. Our advice: treat August 2026 as the live deadline and use any extension as bonus runway, not a reason to delay.

What are the fines for non-compliance?

Fines can reach €35 million or 7% of global annual turnover for prohibited AI, €15 million or 3% for other violations, and €7.5 million or 1% for providing incorrect information. These apply to companies of all sizes, including SMBs.
